On 13 May 2025 Regulation (EU) 2025/877 was published, by which the European Commission is amending Cosmetics Regulation (EC) 1223/2009 in regard to the use of substances classified as carcinogenic, mutagenic or toxic to reproduction (CMR).
The changes result from the most recent update of the classification of substances in the CLP Regulation (EU) 1272/2008, via the Regulation (EU) 2024/197, and will enter into force on 1 September 2025.
What changes :
- Addition of 21 new substances to Annex II (prohibited substances) of the Cosmetics Regulation.
- The use of the substance Trimethylbenzoyl Diphenylphosphine Oxide (TPO)is prohibited. This substance acts as a photoinitiator in professional nail care products.
- Implementing corrections and updates the names and CAS numbers of existing banned substances, for legal clarity.
- These substances cannot be used in professional products either, in any concentration
